The page indicates that the first $3,300 or $5,000 donation from an individual or multiple candidate PAC to the joint fundraising committee would be allocated to Friends of Sherrod Brown and earmarked for the primary election, despite the primary having occurred over a month earlier on March 19, where Brown ran unopposed.

The page also states that subsequent donations up to the same amount would be allocated to Brown's general election fund.

The second allegation revolves around language on the May 8 version of the page, which implied that all contributions of up to $10,000 to the Ohio Grassroots Victory Fund would be utilized to aid Brown's reelection campaign.

FACT contends that this language may have led contributors to believe their donations were specifically earmarked for Brown's campaign activities. Consequently, FACT argues that all contributions to the Ohio Grassroots Victory Fund should be treated as general-election contributions to Brown to prevent circumvention of contribution limits.
