A Venezuelan migrant allegedly committed 22 crimes within six months of entering the U.S., raising questions about the Biden-Harris administration's immigration policies and whether he will face deportation.
An illegal migrant from Venezuela, Daniel Hernandez-Martinez, allegedly committed at least 22 criminal offenses over a six-month period after being released into the United States by the Biden-Harris administration, according to a report released Wednesday by the House Judiciary Committee. Despite this string of alleged crimes, there are doubts about whether he will be deported.
Hernandez-Martinez, suspected of being a member of the "Tren de Aragua" gang, entered the U.S. in early 2023 and soon after began accumulating charges, including petit larceny, criminal possession of a weapon, and multiple assaults, two of which allegedly involved attacks on police officers. Despite these serious accusations, Immigration and Customs Enforcement (ICE) did not detain him until his seventh encounter with the New York Police Department.
"The Biden-Harris Administration released Daniel Hernandez-Martinez into the United States without any legal justification," the House Judiciary Committee's report states. "Mere months after his release, Hernandez-Martinez began terrorizing New York City, committing at least 22 criminal offenses within a span of just six months."
While the House committee report raises concerns about whether Hernandez-Martinez has been removed from the U.S., an investigation by the New York Post suggests he is currently being held in Buffalo, New York. The Department of Homeland Security (DHS) initially resisted providing Hernandez-Martinez’s background file to the Judiciary Committee, eventually submitting the documents months later, despite having them ready six months earlier.
The case of Hernandez-Martinez is highlighted as an example of what critics say are the failures of the Biden-Harris administration's immigration policies. Since President Joe Biden took office in January 2021, over 7 million foreign nationals have been encountered by Border Patrol agents while attempting to enter the country illegally. Vice President Kamala Harris, who previously supported decriminalizing illegal immigration as a U.S. senator, now faces scrutiny for these policies, with her campaign stating that she would maintain a Biden-era executive order to curb illegal crossings.
"The disastrous immigration policies of the Biden-Harris administration have had real-world consequences for American citizens," the House Judiciary Committee wrote in their report. "Hernandez-Martinez’s victims will never be the same because the Biden-Harris Administration allowed him to enter the country. Tragically, Hernandez-Martinez’s victims are not alone."
ICE and DHS have not yet responded to requests for comment on the case.
