Biden Judge Rules Virginia Must Allow 1,600 Non-Citizens To Vote, Youngkin Appeals to Supreme Court

Virginia is taking its fight over 1,600 alleged noncitizens on voter rolls to the Supreme Court, challenging a DOJ-backed ruling that’s sparking heated debate on election integrity.


In a move stirring debate over election integrity, Virginia Attorney General Jason Miyares has petitioned the Supreme Court to block a lower court order mandating the return of roughly 1,600 alleged noncitizens to the state’s voter rolls. This emergency appeal follows a series of judicial decisions favoring voter inclusion, starting when a Biden-appointed federal judge sided with the Department of Justice to halt Virginia’s removal of individuals who, according to the state, "self-identified" as noncitizens. Virginia’s attempt to reverse that ruling through the 4th Circuit Court of Appeals was also denied, with a panel of three Democrat-appointed judges upholding the lower court’s order.


The decision has led to concerns among Virginia officials about election integrity, with Miyares emphasizing the state’s intention to maintain accurate voter rolls. He called the DOJ-backed ruling a “federal overreach” that compromises Virginia's ability to enforce its voter registration standards. The Supreme Court’s response to Virginia’s emergency appeal will be closely watched, as it could shape how states manage their voter rolls ahead of key elections.
